WORCESTER – Judge David Ricciardone today sentenced a Worcester County House of Correction inmate to a total of 5 to 7 ½ in state prison for assaulting corrections officers, according to Worcester County District Attorney Joseph D. Early.
Marcus Stewart, 27, of Worcester, was convicted by a Superior Court jury Thursday afternoon of five counts of assault and battery on a corrections officer. The charges stem from incidents at the county house of correction in 2017 and 2018. The jury also found Stewart guilty of vandalism and disturbing a correctional institution for incidents in 2018.
The jury found Stewart not guilty on a separate vandalism charge from 2017.
Assistant District Attorney Tiffany Scanlon recommended a sentence of 5 to 7 years in state prison. Defense attorney Kernahan Buck recommended a sentence of 2 to 3 years in state prison and two years of probation once he is released.
Judge Ricciardone imposed a 1 year to 1½ year sentence on each of five convictions for assault and battery on a corrections officer. Each of those sentences will run after the previous sentence is served, for a total of 5 to 7½ years.
On the vandalism conviction, Judge Ricciardone ordered a 1 year to 1½ year sentence to run at the same time as the last of fifth sentence for assault and battery on a corrections officer. For disturbing a correctional institution, the judge ordered a 30-day sentence also to run at the same time as the fifth sentence for assault and battery on a corrections officer.
The aggregate sentence of 5 to 7½ years will not begin until December of 2022 when Stewart completes his current term in the Worcester County House of Correction. Stewart was given credit for 121 days served.
