WINCHENDON — One man is dead and another one was arraigned today on an aggravated assault and battery charge after a struggle at a Spruce Street address early last night, according to Worcester County District Attorney Joseph D. Early Jr.
Donald O’Malley, 33, of Spruce Street in Winchendon was pronounced dead at Henry Heywood Hospital in Gardner after he become unresponsive during a fight.
Thomas Maxwell, 49, of 69 East St., pleaded not a guilty in Winchendon District Court. Judge Arthur F. Haley ordered the him held on $50,000 bail. His case was continued to Sept. 9.
It is alleged that shortly after 6 p.m. last night an argument between Mr. Maxwell and Mr. O’Malley grew into a physical altercation. The two men struggled to the ground outside 169 Spruce St. The victim soon became unresponsive. The victim was transported by ambulance to the hospital.
The Office of the Chief Medical Examiner has accepted the case and autopsy will be preformed to determine the cause and manner of death.
